Pursuant to Federal Laws we are required to give individual clients who have engaged our firm for personal, family, or household purposes written notice of our information gathering, retention and disclosure policies. These laws are not applicable to corporations, partnerships, trust or other commercial entities that engage our firm for business or commercial purposes. INFORMATION WE COLLECT:

From time to time Smith, Hiatt & Diaz, P.A. collects information in order to assist individual clients with representation. We collect non-public personal information that comes to us in the following ways:

  • Information we receive from you, such as your name, address, telephone number, or social security number;

  • Information we receive from you on forms that we ask you to fill out for our firm records or applicable to a matter wherein you are being represented;

  • Information related to your transaction with our firm, or affiliates, or others, that we may receive from your Lender, attorney, real estate broker, etc.

  • Information that is publicly available from public records or the Internet

INFORMATION WE DISCLOSE:

Smith, Hiatt & Diaz, P.A., has developed a policy wherein we do not disclose any non-public personal information about our clients or former clients to any one, except as permitted by law. For example, we may disclose your information in connection with a Subpoena or other legal process, or when we record your Mortgage or Deed in the public records.

RESTRICTED ACCESS TO INFORMATION:

We restrict access of non-public information about you to those attorneys and employees who need to know the information in order to provide the services required by you or your Lender. The security and confidentiality of your information is very important to us. We maintain physical, electronic and procedural safeguards, together with firm-wide policies and procedures, created to guard your information against accidental disclosure. Said procedures, comply with appropriate Federal and State Regulations. Our employees and agents cannot use your information for purposes other than those authorized by Smith, Hiatt & Diaz, P.A.
